  • Website refers to Geos, accessible from https://geosapp.com
  • You means the individual using the Service or the legal entity on whose behalf such individual is using the Service, as applicable.

Accessing and using the Service depends on Your acceptance and adherence to these Terms and Conditions. They apply to all visitors, users, and anyone who interacts with the Service.

By using the Service, You agree to comply with these Terms and Conditions. If You do not agree with any part of these Terms, You should not use the Service.

You must be at least 18 years old to use the Service. The Company does not allow users under 18.

You acknowledge and agree that using our Application means You will adhere to Shopify’s policies and guidelines, including Shopify’s Terms of Service and any other rules or policies that Shopify may update or implement over time.

The Company does not control and is not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company is not liable for any damage or loss caused, or alleged to be caused, by or in connection with the use of or reliance on any such third-party content, goods, or services.

We strongly recommend that You review the terms and conditions and privacy policies of any third-party websites or services You visit.

Payment and Billing

All billing and payment processes for the Geos App are handled by Shopify. We are not responsible for and can not handle all monetary-related issues, disputes, or errors related to billing, payments, refunds, or chargebacks. Any such issues should be directed to Shopify’s support team. For more details on Shopify’s subscription and refund policies, please refer to their App Charges Overview, App Charges, Refund App Charges, and other related Shopify policies, which may be updated periodically.

Termination

We may terminate or suspend Your access to the Service without prior notice or liability, for any reason, including if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Despite any potential damages You may incur, the Company’s and its suppliers’ total liability under any provision of these Terms is limited to the amount You actually paid through the Service or $100 USD if no purchase was made. This is also Your exclusive remedy for any claims.

To the fullest extent allowed by law, the Company and its suppliers are not liable for any special, incidental, indirect, or consequential damages. This includes, but is not limited to, loss of profits, data, or information, business interruption, personal injury, or loss of privacy arising from or related to the use or inability to use the Service, third-party software, or third-party hardware, even if the Company or its suppliers were advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion of implied warranties or limitations on liability for incidental or consequential damages. In such cases, the liability of each party will be limited to the maximum extent allowed by law.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You on an “AS IS” and “AS AVAILABLE” basis, with all faults and defects, and without any form of warranty. To the fullest extent permitted by applicable law, the Company, including its Affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, in connection with the Service. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties arising from course of dealing, performance, usage, or trade practice. The Company does not guarantee that the Service will meet Your specific needs, achieve any particular results, be compatible with other software, applications, systems, or services, operate continuously, meet any performance or reliability standards, or be free from errors, nor does it warrant that any errors or defects will be corrected.

Additionally, neither the Company nor any of its providers make any representations or warranties, express or implied, concerning: (i) the operation or availability of the Service, or the accuracy, content, and materials provided; (ii) the uninterrupted or error-free functioning of the Service; (iii) the reliability, accuracy, or timeliness of any information or content delivered through the Service; or (iv) the absence of viruses, scripts, trojan horses, worms, malware, time bombs, or other harmful components within the Service, its servers, content, or communications.

Certain jurisdictions may not permit the exclusion of specific warranties or limitations on statutory consumer rights. In such instances, the exclusions and limitations in this section will apply to the maximum extent allowable under applicable law.

Governing Law

These Terms and Your use of the Service will be governed by and construed in accordance with the laws of the Country, excluding its conflict-of-law principles. Your use of the Application may also be subject to additional local, state, national, or international legal requirements.

Dispute Resolution

If You have any concerns or disputes, You agree to try resolving them informally by contacting the Company.

For European Union (EU) Users
If You are a European Union consumer, You will benefit from any mandatory legal protections afforded to You by the laws of Your country of residence.

United States Legal Compliance
You represent and warrant that (i) You are not located in a country subject to a United States government embargo or designated by the United States government as a “terrorist-supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability
If any provision of these Terms is deemed unenforceable or invalid, that provision will be modified and interpreted to achieve its intended purpose to the fullest extent permissible by applicable law. All other provisions will remain in full force and effect.

Waiver
Except as expressly stated herein, the failure to exercise a right or demand performance under these Terms shall not impair a party’s ability to exercise such right or demand performance in the future. Similarly, the waiver of any breach of these Terms does not constitute a waiver of any subsequent breach.

Translation and Interpretation
These Terms and Conditions may have been translated if We have made them available to You on our Service. In the event of a dispute, the original English text will prevail.

Changes to These Terms and Conditions
We reserve the right to amend or replace these Terms at our sole discretion. If a revision is substantial, We  will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. We will determine what constitutes a material change at our sole discretion.

By continuing to access or use our Service after such revisions become effective, You agree to be bound by the updated terms. If You do not agree to the revised terms, in whole or in part, You must cease using the Website and the Service.
